GENERAL CONDITIONS OF USE OF THE MONTEVERDI CIRCLE PLATFORM (CG, 03/2021)

 

AD classical LLC
AD classical LLC (hereinafter referred to as “AD classical”) is a company incorporated under Swiss law which is mainly engaged in the promotion of classical music, in the organization of training courses, in the education and organization of courses on online platforms, and, in person, in the organization of cultural events and conferences online and in presence.

 

Monteverdi Circle online platform
AD classical has developed an online platform, Monteverdi Circle (hereafter “MC platform”), to offer classical music courses online to students and listeners, as well as recorded educational and cultural content, as well as interviews, debates, and material related to classical music.

It is possible to subscribe annually to MC platform to access exclusive content, technical guides, and other services. It is also possible to become a student of MC professors, both for annual courses and masterclasses.

MC platform is designed and built in such a way as to allow the optimal development of online courses, both in terms of audio quality and functionality, concerning the management of multiple audio and video inputs. In the continuous search for a better quality of service, AD classical reserves the right to modify the technical specifications of the services offered.

The purpose of MC platform is to allow teachers to give face-to-face streaming lessons to students and listeners via Zoom Pro platform (without prejudice to the possibility for MC platform to record the lessons actually held).

 

Functioning of the MC platform
The accounts created will be promptly and electronically notified by e-mail to the recipients together with a username and a personal password chosen by the user. Each user is responsible for the security and secrecy of his username and password, and is therefore responsible for any activity carried out within the account. It is also personal responsibility of each user to log off at the end of each lesson. Each user must promptly inform the administration if they realize that their account is being used fraudulently. MC platform is not in any way responsible and can not under any circumstances be considered as such, for losses and/or damages suffered by users concerning the loss and/or theft of access credentials assigned.

All registered users are required to keep their personal information requested at registration up to date. The administration may, if necessary, suspend or delete user accounts.

 


 

Courses/Masterclasses

Application Process
After registering on MC platform, those interested in becoming students of MC courses/masterclasses will be admitted only with a positive result of the application process, which can be done in the “Apply Now” section on www.monteverdicircle.com.

The students will have to furnish some information and to insert one or several links to their videos of performance in the dedicated field. The videos can be uploaded from different platforms such as Google Drive, YouTube, WeTransfer, Dropbox, etc.

The applications will be reviewed by the Teacher for whom the application is made. The candidates will receive the result of their applications by the MC platform’s administration via e-mail, and will have to proceed with the payment before their course starts.

In case of a negative result, the applicants will be notified as well by MC administration via e-mail. It will not be possible for the applicants to object the outcome of the application in any way.

If the teacher’s course for whom the application is made has no more places, it can be possible to be admitted to the course subsequently, as soon as there are vacant places.

All lessons can be attended by auditors. The audience will consist of MC subscribers and/or students, and will never be more than 100 people. The auditors will not be able to interact in any way with the students and the teacher during the lessons.

 

MC Courses
MC platform offers 2 types of courses:

  • Annual course — 10 lessons (60 min each)
  • Intense course — 5 lessons (60 min each)

The lessons in the annual course can be spread over the year’s time according to the professor’s availability. Once they are accepted to the course, whether it is an intense/annual course or a masterclass, the students will also have an annual “enterprise plan” subscription included in the price of the course. The enterprise plan subscription includes: access to all courses led by all the professors as auditors, access to all live masterclasses to watch, 50% discount on MC exclusive content, access to MC free content, MC forum access. The enterprise subscription will last for 1 year from the moment of paying for the course.

Access to the class happens through the receipt of the course webinar link. Students must have a personal Zoom account to access the webinar. Course webinar links are specifically created by the AD classical administration (hereafter: “administration”) and are communicated via e-mail upon receipt of payment. Students/auditors can access the webinar only on the established date and time after the teacher in charge of the course has logged in. The student in the course, prior to taking the class, will be admitted to participate by the teacher.

The links received, for both students and auditors, are personal and may not be used by any other party.

Students and teachers should be equipped with the appropriate tools to support the lessons (a good internet connection, appropriate electronic devices). MC platform recommends the use of a device equipped with a microphone and speakers that allow for good sound and video resolution.

AD Classical is not responsible for the poor audio/video quality of the lessons if this is due to a malfunction of the student’s/teacher’s/audience’s equipment (device, browser, internet connection, microphone, etc.).

In the case of connection problems on the part of the teacher holding the webinar, if the problem occurs for more than 10 minutes, the lost time will be made up at a later time, at the discretion of the teacher and the student.

All courses will be uploaded to the MC platform once the webinar session is over, and will be available to students and subscribed auditors to watch for 7 days. Subsequently, they will be deleted.

It is not possible for the student, auditors, or teachers to record the lessons in any way for either private or public use.

Upon completion of the course, both students and auditors will be able to receive a certificate of attendance. The certificate will be delivered via e-mail.

 

Refunding a course
A refund is only provided in case of cancellation of the course by the teacher. The amount of refund will be equal to the hours not yet taken by the student, minus 249.00€ — the registration fee integrated into the initial price of the course. The annual subscription called “Enterprise Plan” will continue to be active for the students who have received the refund of the unused lesson hours until the due expiration date.

 

MC Masterclasses
Students admitted to MC masterclasses do not necessarily need to be MC platform subscribers, but they can take advantage of a discount of 49.00€ if they decide to subscribe within one week from the payment for the masterclass.

Access to the masterclass is made through the receipt of the link to the course webinar. The student must have a personal Zoom account to access it. The course webinar links are created by the administration of AD classical (hereinafter: “administration”) and are communicated by e-mail after the payment is received. Students/auditors can access the webinar only on the date and time established, after the teacher in charge of the course has logged in. Prior to taking the class, the student in the course will be admitted to participate by the teacher.

Links received for both students and auditors are personal and may not be used by any other party.

Students and teachers should be equipped with the appropriate tools to support the lessons (a good internet connection, an appropriate electronic device). MC platform recommends the use of a laptop, tablet, or smartphone equipped with a microphone and speakers that allow good sound resolution.

AD classical is not responsible for the poor audio/video quality of the lessons if this is due to a malfunction of the students/teachers/audience’s equipment. (device, browser, internet connection, microphone, etc.).

In case of connection problems on the part of the teacher holding the webinar, if the problem occurs for more than 10 minutes, the lost time will be made up at a later time, at the discretion of the teacher and the student.

All courses will be uploaded to the MC platform once the webinar session is over, and will be available to students and subscribed auditors for 7 days.

The student, auditors, or teachers cannot record the classes for private or public use.

Upon completion of the masterclass, both students and auditors will be able to receive a certificate attesting to their attendance. The certificate will be delivered via e-mail.

 

Refunding a masterclass
The refund of the masterclass is provided only in case of cancellation by the Teacher. The amount of refund received will be equal to the hours not yet incurred minus 49.00€ — the registration fee integrated into the initial price of the masterclass. If the cancellation occurs before the beginning of the masterclass, the refund will be equal to 100% of the paid amount.

 

MC Subscriptions
MC platform provides the possibility to purchase three types of annual subscriptions: Starter Plan (€249/YEAR), Advanced Plan (€332/YEAR), Enterprise Plan (€499/YEAR).

The contents of the respective subscriptions are listed in the Subscribe section of the website www.monteverdicircle.com. Subscribers will be able to choose the courses/masterclasses to be included in their subscription freely in case of subscribing with the starter or advanced plan. Once a course/masterclass has been chosen, it cannot be replaced with others. Payment for the subscription can be made either with a credit card or via Paypal.

The contents present on the site and included in the subscription remain the property of AD classical and may not be reproduced, used, or represented, in part or in full, without written permission from AD classical.
Subscriptions are not subject to refund.

 

Data protection
The processing of personal data in the MC platform takes place to the extent that is necessary for smooth and correct access to the platform itself and the use of its functionalities, such as the processing of an inquiry, courses/masterclasses enrolment, etc. The extent of data processing, however, depends on the functions of the website used by the user. In any case, all user data will be treated in accordance with the requirements established by the rules on data protection.

 

Minors
For students, users, and subscribers who have not turned 18 yet, access to MC platform can only take place with the consent of a parental authority holder. However, registrations to MC platform, enrollment in MC online courses and the purchase of MC subscriptions is sufficient to prove the authorization obtained from the holder of the parental authority. These general conditions are also applicable to all underage students.

 

Intellectual property
All elements present on MC Platform, including logos, texts, images, photographs, videos, sounds, documents, distinctive signs, files, scores, are the property of AD classical and cannot be reproduced, used, or represented, in part or in full, without a written authorization from AD classical.

 

Use of Cookies
MC platform uses cookies. These are small text files that are stored on users’ computers and stored by the browser in use. Cookies do not cause any damage to users’ computers and do not contain viruses.

Most of the cookies used by MC platform fall within the so-called “session” type of cookies, which are necessary for the provision of web pages and, at the end of the consultation of the site, are automatically deleted. Other technical cookies, on the other hand, remain stored on users’ computers until they are deleted and allow to be recognized by the browser next time.

The consent initially expressed by the user can be revoked at any time by blocking cookies in the settings of the browser in use. Blocking cookies may, however, completely prevent or otherwise limit the functionality of MC platform.

 

Responsibility
Within the limits permitted by law, AD classical declines all responsibility for any kind of damage, loss, expense, cost, claim, and right in relation to the MC platform.

Teachers and students/auditors/subscribers are solely responsible for the contents of the lessons and/or any material uploaded to the MC platform, such as data, texts, programs, music, videos, etc.

Teachers and students/auditors/subscribers are solely responsible for the use of the MC platform which cannot be used to carry out illegal or harmful activities of any kind.

 

Acceptance of the general conditions
With successful enrollment in online courses/masterclasses and purchase of subscriptions these general conditions are considered accepted.

 

Changes
AD classical can modify these GTC at any time. The new version of the GTC will be published promptly on the AD classical website www.monteverdicircle.com before it becomes effective.

 

Publication
These GTC, legally binding, are published in electronic format and can be consulted at www.monteverdicircle.com.

 

Partial invalidity
Should one or more provisions of these GTC prove to be invalid or illegal, the remaining provisions will remain enforceable and the contracts valid. In that case, the provision concerned will need to be replaced by an effective provision that comes as close as possible to the provision to be replaced.

 

Applicable law and court of law
Swiss law applies exclusively to these GTC.

For any dispute relating or connected to the use of the MC platform and the contract with AD classical, the court of Lugano, Switzerland, is exclusively competent with the exclusion of any other court.
